End-User License Agreement (EULA) for the Fabrik Plugin
Please read this End-User License Agreement (“EULA”) carefully before using the Fabrik plugin software (“software”). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the software.
License grant: This EULA grants you a non-exclusive, non-transferable, revocable license to use the software solely for your personal or internal business purposes on the terms and conditions set forth herein.
Restrictions: You may not distribute, sell, rent, lease, sublicense, or otherwise transfer rights to the software. You may not modify, reverse engineer, decompile, or disassemble the software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
Third-party software: The software may incorporate and distribute certain third-party software components including iPlug2, WebView2, WebKit WebView, VST3, and Audio Units (AU) technologies. Your use of the software acknowledges that you agree to comply with any applicable third-party licenses for these components.
Disclaimer of warranty: The software is provided “AS IS,” without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability: To the maximum extent permitted by applicable law, in no event shall the developers of KreisKlang be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the software, even if the developer has been advised of the possibility of such damages.
Termination: This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from the developer if you fail to comply with any term(s) of this EULA. Upon termination, you shall cease all use of the software and destroy all copies of the Software.
This EULA will be terminated when the commercial version of Fabrik is released.
Governing Law: This EULA shall be governed by the laws of the jurisdiction of Germany.
Privacy: Please review our privacy policy at kreisklang.com/privacy, which also governs your use of the software, to understand our practices.
Feedback and Communications: For feedback, support, and communications, please refer to kreisklang.com. Any feedback you provide shall be deemed non-confidential and the developer has the right to use such feedback without restriction.
Modifications to this EULA: The developer reserves the right to modify the terms and conditions of this EULA at any time. Changes to the EULA will be communicated to users through an email notification and a notification within the software interface at least 14 days prior to the changes taking effect. Continued use of the software after such changes have been notified will constitute your consent to the modified EULA. If you do not agree to the changes, you must stop using the Software and uninstall it. Your continued use of the software following the notice and after the effective date of any changes will constitute your acceptance of such changes.
